Apex Lawn and Snow LLC, DBA-Apex Dumpster Rental, Dumpster Rental Agreement

Standard dumpster rentals are for 14 Days for the 15 and 20 Yard Dumpsters. Each day after will be billed at $10 per day when pre-agreed upon. Extra days beyond the pre-agreed upon days can not be guaranteed.

The 7 Yard Heavy Material Dumpster includes 3 days in the standard price and is $40 per day after the first 3 days.

Dumpster provider will do all they can to meet the specific dates ordered online but may need to drop-off/pickup slightly ahead or behind schedule. Provider will notify client of changes to drop-off/pickup times.

The clients rental will be reserved at the time that the client places their credit/debit card on file. The initial fee will then be charged and the card will stay on file in case of overages. Apex Lawn and Snow LLC, DBA- Apex Dumpster Rental uses stripe.com for card processing.

• No loads are permitted to exceed the height of the dumpster's side walls. There will be a $25 minimum fee to unload to an acceptable height and all overloaded items will be left on property.

• Unauthorized items will be charged a fee. Unauthorized Appliances will be charged a fee of no less than $75.

• Apex Dumpster Rental is the only entity permitted to move the dumpster. Customers are not allowed to move the dumpster under any circumstance.

• Shingles can only be up to 35 Square per dumpster. No other materials are permitted to be with the shingles. Shingles, tar paper, nails only. Dane County Landfill will not accept mixed shingle loads. If other materials are with the shingles, the load will need to be taken to a special drop off site, resulting in dumping fees of $150 per ton.

• Customer shall inspect dumpster upon arrival and will be held responsible for any damage they cause.

• Adequate access to dumpster: customer shall have the dumpster accessible for Apex at pickup time. An inaccessible dumpster causing a dry run will result in a $50-$250 charge plus extra day charge if applicable.

• If Apex Dumpster Rental is required to wait longer than 10 minutes to retrieve a dumpster, do to the dumpster being blocked, the customer will be charged $80/hr.

• Off street parking for the dumpster is a requirement. (Most municipalities do not allow dumpsters/trailers to be placed on the street without a permit)

• After the included tonnage, excess tonnage will be charged at $65 per ton or the drop off locations charge rate. (Whichever is higher)

• In the event of a dry run there will be a dry run charge of $50-$250 and customer will be charged for extra days required to retrieve dumpster.

• Max Tonnage: the maximum allowable weight is four tons. Exceeding this limit will result in a dry run charge and the client will be required to unload the excess weight.

• Tires will incur a fee of no less than $10 per tire. Unless prearranged. (Must be off the rim)

• Concrete must be clean. No rebar, dirt or other products are allowed and concrete must be hauled alone. Concrete loads are only permitted in the 7 Yard Dumpster.

• Shingles must be by themselves. Shingles, Tar paper and Nails only. $85 minimum fee for shingles that have other trash with them or the load will be taken to a special drop off location and the customer will be charged $150 per ton.

• Any landfill/recycling plant fees associated to the load will be charged back to the customer at the rate stated in the contract or at the landfill/recycling plant rate plus time/labor.

• No refunds or extra days will be given for poor weather or other situations that Apex Dumpster Rental cannot control.

• Cancellation Policy: Cancellation made at least 7 days prior to the drop off date will be refunded in entirety minus any processing fees. No refund can be guaranteed within the 7 days of the rental. Card processing fees will not be refunded.

• No refunds will be given for dumpsters that are returned early. This includes additional days that were purchased.

• Apex Dumpster Rental shall not be responsible for any damage or staining to driveways, pavement, lawns, walls, fences, mailboxes, irrigation systems, shrubbery, wells, or septic systems. Customer assumes all liabilities for damage to pavement/curbs, lawns, walls, fences, mailboxes, irrigation systems, shrubbery, wells, and septic systems. It is the customer's responsibility to make Apex Dumpster Rental aware of any underground utilities, which might be affected by the taking of delivery of the container.

• If customer would like boards placed under the container, those boards will be provided by the customer.

• Customer assumes all liability for overweight fines levied by state law.

• Before delivery, customer is responsible for obtaining any street use permit and/or barricades needed. Any assessed fines will be paid for at expense to the customer.

• All third-party compaction services (for example, the Smash my Trash franchise) are prohibited. Customer is responsible for all damages done to Apex Dumpster Rental property by any compaction equipment. If violated, customer will be liable for repair costs up to, but not limited to, complete replacement of the equipment.

• Customer grants Apex Dumpster Rental the right to charge the provided credit card. Fees will be collected for entire standard rental cost and may also be collected to include charges for restricted items/materials, tonnage overages, additional days, and other applicable fees.

• In no event shall Apex Dumpster Rental be liable to customer or to any third party for consequential, incidental, or special damages, or for lost profits, resulting from or in any manner related to the rental of its equipment, products, their delivery, non-delivery, design use, or any inability to use the same, whether such damages be claimed under contract, tort, or any other legal theory. Customer understands that the sole and exclusive remedy of customer shall be the repair or replacement of any defective equipment and/or the refund of rental charges. The limitation shall survive the termination, expiration, or cancellation hereof.
